Terms of Use

These terms are an agreement between you and Groundwork ("Groundwork," "we," "us") for your use of the Groundwork website, map app and related services (the "Service"). By using the Service or creating an account, you agree to these terms. If you don't agree, don't use the Service.

1. What Groundwork is, and isn't

Groundwork is a screening tool that gathers public information about land and estimates things like value and development costs. It is not a survey, appraisal, title search, engineering study, soil evaluation, environmental assessment, or legal, financial or real estate advice. Property lines, flood zones, wetlands, soil ratings, distances, comps, cost ranges and every other result are approximate and may be out of date or wrong. Always confirm with licensed professionals and the responsible agencies before you buy, sell, build or make any decision.

2. Ownership and permitted use

The Service, including its software, design, text, graphics, analysis methods, calculations, reports and the selection and arrangement of information, is owned by Groundwork and protected by copyright, trademark and other laws. "Groundwork" and our logo are our trademarks. We give you a limited, personal, non-exclusive, non-transferable, revocable permission to use the Service for your own land research.

The public records shown in the Service belong to the agencies that publish them. These terms don't limit your right to get those records from their original sources.

3. What you may not do

4. Accounts

You're responsible for your account, for keeping your password private, and for what happens under it. Give accurate information. You must be at least 18. We may suspend or close accounts that break these terms or put the Service or other users at risk.

5. Your content

You keep ownership of what you add, such as saved places, notes, comps, plans, profile details and messages ("Your Content"). You give us permission to store, process and display Your Content as needed to run the Service for you and the people you send it to. You're responsible for Your Content and confirm you have the right to share it.

6. Messages, quotes and contractors

Groundwork lets you contact other users and request quotes. We don't employ, endorse, license, insure or check the background of any contractor or user, and we aren't a party to any agreement you make with them. Do your own checks (license, insurance, references, written contract). Any quote, work, payment or dispute is between you and the other party.

7. Third-party data and services

The Service shows information and map imagery from government agencies and other providers, and links to other sites. We don't control them and aren't responsible for their accuracy, availability or terms. Your use of them may be subject to their own terms.

8. Fees

The Service is free during the beta. If we introduce paid plans, we'll tell you the price and terms before you're charged, and you'll choose whether to subscribe.

9. Disclaimers

THE SERVICE AND ALL INFORMATION IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, GROUNDWORK WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSSES FROM DECISIONS ABOUT PROPERTY, CONSTRUCTION OR CONTRACTORS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF $100 OR WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnity

You'll defend and hold Groundwork harmless from claims and costs arising from your misuse of the Service, Your Content, your dealings with other users or contractors, or your breaking these terms.

12. Ending use

You can stop using the Service and delete your account at any time from your account's Security page. We may suspend or end access if you break these terms. Sections 2, 3, 9, 10, 11 and 13 continue after your use ends.

13. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction.

14. Changes

We may update these terms. If a change is significant, we'll let account holders know before it takes effect. Continuing to use the Service after that means you accept the new terms.
